CCM Vancouver Legal Clinic provides legal consultation, advice, and referral services under the following terms and conditions:

1. Definitions
   
   
   
   1. "Applicant": The person or entity that completes or submits an application form, whether on the Legal Clinic’s website or a physical form in person, and/or calls the Legal Clinic to request service(s) regardless of whether or not any service has been provided.
   
   
   2. "CCM": Chinese Christian Mission of Canada.
   
   
   3. "Client": The person or entity that receives any services from the Legal Clinic which the Legal Clinic agrees in writing to provide.
   
   
   4. "Income and Asset Criteria": The criteria established by the Legal Clinic and published on its website. The criteria are subject to change from time to time at the discretion of the Legal Clinic.
   
   
   5. "Intake": The initial phone call or meeting between an Applicant and the Legal Clinic for the purpose of determining whether the Legal Clinic will accept the Applicant as a Client or refer the matter to a third party.
   
   
   6. "Legal Clinic": The CCM Vancouver Legal Clinic.
   
   
   7. "Volunteer Lawyer": A lawyer qualified to practice law in British Columbia and provides pro bono legal services in connection with the Legal Clinic.
   
   
   
   


2. Scope of Services
   
   
   
   1. The Legal Clinic provides legal consultation, advice, and referrals only, and does not provide legal representation unless explicitly agreed upon in writing.
   
   
   2. Submitting an Intake form, attending an Intake call, or receiving advice from the Legal Clinic does not establish a lawyer-client relationship under any circumstances.
   
   
   
   


3. Eligibility of Services
   
   
   
   1. The Legal Clinic primarily serves applicants who meet the Income and Asset Criteria. However, acceptance of an Applicant is at the sole discretion of the Legal Clinic.
   
   
   2. An Applicant is ineligible for services from the Legal Clinic regarding a matter if they have already hired another legal service provider for the same matter.
   
   
   
   


4. Intake Process
   
   
   
   1. The purpose of the Intake call or meeting is for better understanding of an Applicant’s situation and to equip an Applicant to make an informed decision.
   
   
   2. The Applicant may receive consultation from a Volunteer Lawyer or be referred to other legal professionals, community legal clinics, or social service agencies, as appropriate.
   
   
   
   


5. Confidentiality
   
   
   
   1. The Legal Clinic takes reasonable measures to protect confidentiality and security of personal information. Any personal information provided by the Applicant is treated as confidential and used solely for the purpose of evaluating and addressing the Applicant’s needs.
   
   
   2. Such information received may be shared with Legal Clinic staff and advisory members, Volunteer Lawyers, and CCM staff and volunteers, as applicable, in connection with and for the purpose of providing services to the Applicant. Sharing with external parties, such as referral organizations, will only occur with the Applicant’s explicit consent.
   
   
   
   


6. Applicant’s Responsibilities
   
   
   
   1. The Applicant must provide true, complete and accurate information to the Legal Clinic. Providing false, intentionally misleading or incomplete information may result in denial or termination of services.
   
   
   2. The Applicant acknowledges that any advice provided is based solely on the information provided and the limited scope of the consultation.
   
   
   3. Unless otherwise agreed upon in writing, although the Legal Clinic may provide legal guidance and advice, the Applicant remains solely responsible for conduct and management of the legal matter, including without limitation ensuring deadlines are met and taking required action in a timely manner. The Legal Clinic is not responsible for missed deadlines, incomplete filings, or any adverse outcomes resulting from the Applicant’s failure to take necessary actions.
   
   
   
   


7. Faith-Based Services
   
   
   
   1. Although the Legal Clinic provides services to individuals regardless of personal faith backgrounds, the Legal Clinic operates as a Christian faith-based service. Advice provided may include alternative dispute resolution and faith-based support such as prayer, spiritual advice, or counselling and other supportive services.
   
   
   2. Faith-based advice is intended to supplement legal advice to provide holistic support to an Applicant. It is optional, and an Applicant may decline without affecting his/her access to legal consultation or referrals.
   
   
   
   


8. Liability Waiver
   
   
   
   1. The Applicant acknowledges and agrees the Volunteer Lawyers, the Legal Clinic, CCM, and their respective employees, volunteers, board members, representatives, agents, successors and assignees are not responsible for any loss, damage, or injury, whether direct, indirect, incidental, consequential or otherwise, arising from services provided, nor any actions or decisions taken by the Applicant based on the information or services received.
   
   
   2. The Applicant acknowledges and agrees to release, indemnify, and save harmless the Volunteer Lawyers, the Legal Clinic, CCM, and their respective employees, volunteers, board members, representatives, agents, successors and assignees from any and all claims, liabilities, or damages arising from or related to services provided.
   
   
   
   


9. Interpretation
   
   
   
   1. Headings – The headings in this Terms and Conditions are for convenience only and shall not affect its interpretation.
   
   
   2. Singular and Plural – Words in the singular include the plural and vice versa.
   
   
   3. Translation – The Chinese version of this Terms and Conditions below is included for convenience only. In the event of any conflict or discrepancy, the English version shall prevail.
   
   
   
   


10. Acceptance of Terms
    By engaging with the Legal Clinic’s services, the Applicant acknowledges that he/she has read, understood, and agreed to these terms and conditions.

中信溫哥華法律援助中心根據以下服務細則及條款提供法律諮詢、建議和轉介服務：

   1. 「申請人」：指完成或提交申請表的個別人士或單位，無論是透過法援中心的網站、親自填寫表格，或致電法援中心徵詢服務，不論最終是否獲得服務。

   3. 「客戶」：指接受法援中心提供的服務，且中信法援書面同意提供服務的個別人士或單位。

   7. 「義務律師」：持有卑詩省執業資格並為法援中心提供義務法律服務的律師。
      
   
   


2. 服務範圍
   
   
   
   1. 法援中心僅提供法律諮詢、建議和轉介服務，除非書面明確同意，否則不會提供法律代理或代表服務。
      
   2. 提交初步評估表、參與初步評估通話或接受法援中心提供的建議，均不構成律師與客戶之間的關係。
      
   
   
3. 服務資格
   
   
   
   1. 法援中心主要為符合收入與資產標準的申請人提供服務。然而，法援中心可保留是否接納個別申請人的酌情權。
      
   2. 如果申請人已經就同一事宜僱用其他律師或法律服務， 該申請人之申請將不受理。
      
   
   
4. 初步評估程序
   
   
   
   1. 初步評估通話或會面之目的是讓法援中心更多瞭解申請人的情況，以便申請人能夠作出知情的法律決定。
      
   2. 申請人可能會接受義務律師的法律諮詢，或被轉介至其他法律專業人士、社區法律援助中心或社會服務機構。
      
   
   
5. 資料保密
   
   
   
   1. 法援中心採取合理措施保護個人資料的機密和安全。申請人提供的任何個人資料將屬保密，並僅用於評估和處理申請人的需求。
      
   2. 法援中心職員及顧問、義務律師以及 CCM 的相關職員和義工將共享所收集的資料，以便提供服務。若需與外間機構（如轉介機構）共享 有關資料，必先取得申請人的明確同意。
      
   
   
6. 申請人的責任
   
   
   
   1. 申請人必須向法援中心提供真實、完整和準確的資料。如提供虛假、故意誤導或不完整的資料，可能會導致服務被拒絕或終止。
      
   2. 申請人確認，法援中心提供的任何建議僅基於申請人提供的資料以及有限的諮詢範圍。
      
   3. 除非另有書面協議，雖然法援中心可提供法律指導與建議，但申請人須自行負責案件的管理與處理，包括但不限於確保遵從所有時限要求並及時採取必要行動。法援中心不須對申請人未能採取必要行動而導致的錯過期限、不完整申請或其他不利結果負責。
      
   
   
7. 基督信仰背景的服務
   
   
   
   1. 儘管法援中心為所有個人提供服務，不論其個人信仰背景為何，但本機構乃是一間基督教信仰背景的機構，提供的建議可能包括替代性爭議解決方案及以信仰為基礎的支援服務，例如祈禱、屬靈建議、輔導和其他支援服務。
      
   2. 信仰相關的建議旨在補充法律建議，以提供全人關懷。此項服務為選擇性服務，申請人可自由拒絕，而不影響其獲得法律諮詢或轉介服務。
      
   
   
8. 免責聲明
   
   
   
   1. 申請人確認並同意，義務律師、法援中心、CCM 及其相關員工、義工、董事會成員、代表、代理人、繼任人及受讓人對於所提供的服務、申請人根據所獲得的資訊或服務所作出的任何行動或決策，概不承擔任何直接、間接、附帶、後果性或其他任何類型的損失、損害或傷害的責任。
      
   2. 申請人確認並同意，將免除、賠償並使義務律師、法援中心、CCM 及其相關員工、義工、董事會成員、代表、代理人、繼任人及受讓人免於因提供服務而產生的任何及所有索賠、責任或損害。
      
   
   
9. 條款解釋
   
   
   
   1. 標題 – 本條款與條件中的標題僅為方便閱讀，並不影響其解釋。
      
   2. 單數與複數 – 單數詞包括複數詞，反之亦然。
      
   3. 翻譯文本 – 中文版本僅供參考，若與英文版本存在任何衝突或差異，以英文版本為準。
      
   
   
10. 條款確認
    申請人確認其使用法援中心的服務即表示其確認已閱讀、理解並同意遵守以上服務細則及條款。
